These Terms of Use ("Terms") are a legally binding agreement between you and Biwee Team ("Biwee", "we", "us", or "our") governing your access to and use of the Biwee mobile application and related services (collectively, the "Service").
If you do not agree to these Terms, do not use the Service.
1) Eligibility (17+)
The Service is intended for users who are 17 years of age or older. By using the Service, you represent that you are at least 17. If you are under 17, you may not use the Service.
2) The Service
Biwee helps users identify plants from photos or uploaded images and maintain a personal plant journal. The Service may provide plant names, species information, and educational content.
Important: Biwee is for informational and educational purposes only and is not professional medical, veterinary, agricultural, or safety advice.
Do not rely on the Service to determine whether a plant is safe to eat, touch, or use. Always use caution and consult qualified sources or professionals as appropriate.
3) Account Registration and Security
- Provide accurate and current information (name/username/email as applicable).
- Keep your login credentials confidential.
- Notify us promptly of unauthorized access or suspected security breaches.
You are responsible for all activities that occur under your account.
4) User Content
"User Content" includes photos/images you upload, journal entries, notes, and any other content you submit or store through the Service. You retain ownership of your User Content.
You grant Biwee a limited, non-exclusive, worldwide license to host, store, process, and display your User Content solely to operate, provide, maintain, and improve the Service and to provide the features you request (including plant identification and journal functionality).
5) Plant Identification and AI Processing
Your control: You decide whether to upload images/text for identification.
Processing location: Uploaded images/text are processed on Biwee Team’s own servers.
No third-party sharing for processing: We do not share uploaded images/text with any third party for generating identification results.
Deletion after processing: We delete uploaded images/text from our processing servers as soon as reasonably practicable after results are generated.
No training / no marketing: We do not use your uploaded images/text for advertising or marketing training purposes.
6) Acceptable Use
- Do not use the Service in violation of law or regulation.
- Do not upload unlawful, harmful, infringing, deceptive, or abusive content.
- Do not reverse engineer, disrupt, bypass security, or interfere with the Service.
- Do not scrape or automate access in a way that burdens the Service.
- Do not misuse the Service to identify individuals or attempt face recognition.
7) Intellectual Property
The Service (excluding User Content) is owned by Biwee Team or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except as permitted by law or expressly authorized by us.
8) Subscriptions and Payments (If Applicable)
If the Service offers paid features, pricing and payment terms will be shown at the time of purchase. Purchases may be processed through the Apple App Store and are subject to Apple’s terms and policies. Subscription management (including cancellation) is handled through your Apple ID account settings.
9) Privacy
Our collection and use of information is described in our privacy practices. By using the Service, you acknowledge that you understand how we handle data.
10) Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or if needed to comply with law or protect the Service, users, or our rights.
11) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee identification accuracy or completeness.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIWEE TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO BIWEE TEAM (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $10 IF YOU HAVE NOT PAID ANY AMOUNTS.
13) Governing Law; Binding Arbitration
These Terms are governed by the laws of Biwee Team’s principal place of business, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, and not in a class, consolidated, or representative action, except where prohibited by applicable law.
14) Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a revised Effective Date. By continuing to use the Service after changes become effective, you agree to the updated Terms.
